This Privacy Policy describes how Rendever, Inc. (“Rendever,” “we,” “us,” or “our”) collects, uses, and discloses information in connection with the CommunityOS marketing website located at gocommunityos.com, together with its subdomains and any associated or successor pages, features, forms, and informational services (collectively, the “Site”).

The Site is an informational and marketing website that provides information about the CommunityOS platform and allows visitors to request demonstrations, contact us, and otherwise learn about our products and services. This Privacy Policy applies solely to information we collect through the Site. It does not apply to the CommunityOS application or other services that our enterprise customers license from us, which are governed by separate agreements and notices.

When one of our enterprise customers (for example, a senior living operator) provides information to us in connection with our provision of services to that customer, and we process such information solely on that customer’s behalf, this Privacy Policy will not apply to the processing of that information, and that enterprise customer will be responsible for having a lawful basis for processing that information, for acting in all matters in accordance with all applicable laws, and for providing you with all requisite information as required by applicable law.

As used in this Privacy Policy, “personal information” means information that identifies, relates to, describes, or is reasonably capable of being associated with a particular individual, and the terms “process” and “processing” include collecting, storing, evaluating, modifying, deleting, using, combining, analyzing, disclosing, and transferring information within Rendever or among our affiliates.

By using the Site, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with it, please do not use the Site.

WHAT INFORMATION ABOUT ME IS COLLECTED?

We collect information in the following ways: information you provide to us directly, information we collect automatically as you use the Site, and information we receive from third parties.

Information You Provide to Us

When you complete a form on the Site - such as a “Book a Demo” request, contact form, or newsletter sign-up - or otherwise communicate with us, we may collect personal information you choose to provide, which may include:

  • Your first and last name;
  • Business e-mail address and telephone number;
  • Company or organization name, job title, and role;
  • The senior living community or organization you are associated with;
  • Any information you include in the message, comments, or free-text fields of a form; and
  • Any other information you voluntarily provide when you call, e-mail, or otherwise contact us for sales, marketing, support, or other purposes.

Information We Collect Automatically

When you visit the Site, we and our service providers may automatically collect certain information about your device and your interaction with the Site using cookies, pixels, web beacons, log files, and similar technologies. This information may include:

  • Internet Protocol (IP) address and the general geographic location inferred from it;
  • Browser type and language, operating system, and device type and identifiers;
  • Referring and exit URLs, the pages and content you view, and the dates, times, and duration of your visits; and
  • Aggregated and statistical data regarding use of the Site.

Information From Third Parties

We may receive information about you from third-party sources, including analytics and advertising providers, marketing and lead-generation partners, business contact data providers, and our affiliates. We may combine this information with information we collect through the Site and use the combined information as described in this Privacy Policy.

 

HOW IS INFORMATION COLLECTED, INCLUDING THROUGH THE USE OF COOKIES AND SIMILAR TECHNOLOGIES?

“Cookies” are small text files placed on your computer or mobile device that allow us to recognize your web browser and collect information. We use cookies and similar technologies to operate and secure the Site, remember your preferences, understand and analyze how the Site is used, measure the effectiveness of our marketing, and deliver advertising that may be relevant to you on the Site and on other websites and platforms, including social media platforms such as LinkedIn and Facebook.

Some cookies and similar technologies are placed by third parties that provide us with analytics, advertising, and related services. The Site uses analytics services, including Google Analytics, to help us understand how visitors use the Site. “Web beacons,” also known as action tags or gif tags, are a web technology used to help track website usage information, such as how many times a specific page has been viewed. They are invisible to you, and any portion of the Site, or any e-mail sent on our behalf, may contain them.

We also collect information through our Internet log files, which record data such as IP addresses, browser types, domain names, and other statistical data involving use of the Site. This information may be used to analyze trends, administer the Site, monitor its use, and gather general demographic information. Finally, other third parties may use their own cookies or similar technologies when you click on a link to their websites or services from the Site; this Privacy Policy does not govern the use of cookies or similar technologies by such third-party websites or services.

 

WHAT DOES RENDEVER DO WITH THE INFORMATION IT COLLECTS?

We use the information we collect for the following purposes, to the extent permitted by applicable law:

  • To operate, maintain, secure, and improve the Site;
  • To respond to your inquiries, schedule and conduct demonstrations, and provide customer service and support;
  • To send you information about our products, services, events, and offers that may be of interest to you, unless you opt out;
  • To personalize and improve your experience and to develop new products, services, and features;
  • To perform analytics and to measure and improve the effectiveness of our marketing and advertising;
  • To conduct internal business operations, including auditing, fraud prevention, and security;
  • To comply with legal obligations and enforce our agreements and policies; and
  • For any other purpose disclosed to you at the time we collect the information or to which you consent.

Unless you opt out, we and third parties may send you electronic newsletters and contact you about the Site, products, services, information, and news that may be of interest to you. If you no longer desire to receive these communications, you may change your preferences by following the directions in any marketing communication we send to you, or by contacting privacy@rendever.com. We may still send you non-marketing administrative communications, such as responses to your inquiries, which are necessary for the performance of our services.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

 

WHEN DOES RENDEVER DISCLOSE INFORMATION TO THIRD PARTIES?

We generally disclose information we gather from you through the Site to the following types of third parties and as otherwise set forth in this Privacy Policy or as specifically authorized by you.

Service Providers.

We engage third-party vendors, contractors, and suppliers to perform services on our behalf, such as website hosting, customer relationship management, e-mail and marketing delivery, analytics, advertising, and security. These service providers may have access to information as needed to perform their functions, and we use reasonable efforts to ensure that they are capable of protecting the security of your information.

Advertising and Analytics Partners.

As described above, we work with advertising and analytics partners that may collect information about your activity on the Site and elsewhere over time and across different websites in order to provide measurement services and deliver targeted advertising. This includes Google Analytics and advertising services such as those offered by Google, LinkedIn, and Facebook. You may opt out of a third-party vendor’s use of cookies for personalized advertising by visiting optout.aboutads.info.

Laws and Legal Rights.

We may disclose your information if we believe in good faith that we are required to do so in order to comply with an applicable statute, regulation, rule, or law, a subpoena, a search warrant, a court or regulatory order, lawful requests by public authorities, including to meet national security or law enforcement requirements, or other valid legal process. We may disclose information in special circumstances when we have reason to believe that doing so is necessary to identify, contact, or bring legal action against someone who may be violating a contract with us, to detect fraud, or to protect the safety and/or security of our users, the Site, or the general public.

Sale of Business.

We reserve the right to transfer information to a third party in connection with a sale, merger, or other transfer of all or substantially all of the assets of Rendever or any of its Corporate Affiliates, or that portion of Rendever or any of its Corporate Affiliates to which the Site relates, or in connection with a strategic investment by a third party in Rendever, or in the event that we discontinue our business or file, or have filed against us, a petition in bankruptcy, reorganization, or similar proceeding.

Affiliates.

We may disclose information about you to our Corporate Affiliates. For purposes of this Privacy Policy, “Corporate Affiliate” means any person or entity that directly or indirectly controls, is controlled by, or is under common control with Rendever, whether by ownership or otherwise; and “control” means possessing, directly or indirectly, the power to direct or cause the direction of the management, policies, or operations of an entity, whether through ownership of fifty percent (50%) or more of the voting securities, by contract, or otherwise.

Aggregated and De-Identified Information.

We may create and share aggregated, anonymized, or de-identified information that cannot reasonably be used to identify you for any purpose permitted by law.

 

DOES THIS PRIVACY POLICY APPLY WHEN I LINK TO OTHER WEBSITES OR SERVICES?

The Site may provide you with access to other websites and services that we do not operate or control. Please be aware that we are not responsible for the privacy practices of any websites or services other than the Site. A link to a third-party website does not constitute or imply endorsement by us. Additionally, we cannot guarantee the quality or accuracy of information presented on those websites. We encourage you to read the privacy policies or statements of each and every such website and service. This Privacy Policy applies solely to information collected by us through the Site.

 

IS THE INFORMATION COLLECTED THROUGH THE SITE SECURE?

We want your information to remain secure. We strive to transmit your information from your computer or mobile device to our servers through techniques that are consistent with commercially reasonable standards, and to employ administrative, physical, and electronic measures designed to protect your information from unauthorized access.

Notwithstanding the above, you should be aware that there is always some risk involved in transmitting information over the Internet. There is also some risk that others could find a way to thwart our security systems. As a result, while we strive to protect your information, we cannot ensure or warrant the security or privacy of any information you transmit to us, and you do so at your own risk.

 

FOR HOW LONG WILL MY INFORMATION BE KEPT?

We will only retain your personal information for as long as necessary to fulfill the purposes for which we collected it, including to provide our services, communicate with you, and satisfy our legal, accounting, or reporting obligations. To determine the appropriate retention period, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it and whether we can achieve those purposes through other means, and the applicable legal requirements.

 

COULD MY INFORMATION BE TRANSFERRED TO OTHER COUNTRIES?

The Site is operated from the United States and is intended for users located in the United States and Canada. If you access the Site from outside these countries, you do so on your own initiative. By using the Site and submitting information through it, you understand that your information may be transferred to, stored in, and processed in the United States and other jurisdictions that may not have laws of general applicability regulating the use and transfer of such information. Except where applicable law provides otherwise, all aspects of the Site and our relationship with you are governed by the internal laws of the United States and the Commonwealth of Massachusetts, USA, regardless of your location.

 

WHAT PRIVACY RIGHTS DO I HAVE IF I AM A U.S. STATE RESIDENT?

We do not sell personal information for money. However, certain disclosures we make for online advertising and analytics may be considered a “sale” or “sharing” of personal information, or processing for “targeted advertising,” under some state laws. You may opt out of such activity by using our cookie preference tool, by following the instructions in the “Do Not Sell or Share My Personal Information” link where available on the Site, or by contacting us as described below.

We honor opt-out preference signals, including the Global Privacy Control (GPC), transmitted by your browser or device where required by applicable law. When we detect such a signal, we treat it as a request to opt out of the sale or sharing of personal information for the browser or device from which it is sent.

We will verify your request before fulfilling it and will respond within the timeframes required by applicable law. If we deny your request, you may have the right to appeal by replying to our response, and we will inform you of the outcome of any appeal as required by law.

 

WHAT INFORMATION APPLIES TO CANADIAN RESIDENTS?

If you are located in Canada, we process your personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws, including Quebec’s Act respecting the protection of personal information in the private sector (Law 25). We collect, use, and disclose personal information with your consent, which may be express or implied depending on the sensitivity of the information and the circumstances, or as otherwise permitted or required by law.

Subject to applicable law, Canadian residents may request access to, correction of, or withdrawal of consent to our processing of their personal information. Your personal information may be stored and processed in the United States and may be accessible to courts, law enforcement, and governmental authorities in those jurisdictions in accordance with their laws. DOES RENDEVER COLLECT INFORMATION FROM CHILDREN UNDER 13 YEARS OF AGE?

We are committed to protecting the privacy of children. The Service is not designed for or directed to children under the age of 13. We do not collect personally identifiable information from any person we actually know is under the age of 13.

 

DO NOT TRACK AND OPT-OUT PREFERENCE SIGNALS

The term “Do Not Track” refers to an HTTP header offered by certain web browsers to request that websites refrain from tracking the user. Because there is not yet a common industry or legal standard for recognizing or honoring Do Not Track signals, we do not currently respond to browser Do Not Track signals. We do, however, honor the Global Privacy Control and other opt-out preference signals where required by law, as described above.

 

HOW WILL I KNOW IF THERE ARE ANY CHANGES TO THIS PRIVACY POLICY?

We may revise this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other reasons. When we make changes, we will revise the “Last modified” date at the top of this Privacy Policy and, where required by law, provide additional notice.
